


Terms & Conditions
These are the Terms & Conditions of Sale on which Terminator Boats Ltd does business with you, the Customer. These terms are important as they govern our relationship, so please read them carefully and contact us if you have any questions. Nothing in these Terms and Conditions shall affect any rights you may have under the Consumer Guarantees Act 1993 (New Zealand) where it is applicable.
Parties
Terminator Boats Ltd (may be referred to below as "us" or "we".
Customer (may be referred to below as “you” or “your”).
Quotes
Quotations supplied by us, Terminator Boats Ltd, to you, the customer, are valid for a period of 2 weeks from date of issue. Quotes are in New Zealand dollars unless otherwise stated and will be inclusive of GST but exclusive of any insurance, freight or delivery charges unless specified. A quotation does not give rise to a binding contract until you make a payment and we issue an invoice.
Agreements & Invoices
An agreement is in place when you have made either a full or deposit payment to us and we have issued you with an invoice detailing the product or products being supplied and all associated payments and costs. Invoices are in New Zealand dollars unless otherwise stated and will be inclusive of GST but exclusive of any insurance, freight or delivery charges unless specified.
In entering into an agreement you agree to these Terms and Conditions of Sale and consent to be bound by New Zealand law and to the jurisdiction of the New Zealand Courts for the purpose of resolving any dispute arising between the parties as a result of the transaction.
Deposits
A deposit is payable to secure any order. Deposits will be the greater of either $500 or 10% of the total order value.
We require a deposit of 50% of the total order value prior to any irrevocable purchases or customer specified modifications being made. This includes, but is not be limited to, the buying and/or fitting of engines, consoles and other accessories.
Please note that all deposits are non-refundable.
Balance of Payment
All goods must be paid for in full prior to dispatch or release to the customer.
Methods of Payment
We accept payment by cash, cheque, direct credit, EFTPOS or Mastercard/Visa. Please note that in the event of payment by cheque or direct credit, goods will only be released once funds have been cleared into our account.
Delivery
Please inspect your goods very carefully to ensure that all is as you expected and that there is no damage before accepting delivery. If you find damage or any items are missing, you should contact us immediately.
Approval or Return Policy
We offer a 10 day approval period on the sale of any boat or trailer subject to the exclusions noted below. Goods must be in an ‘as new’ condition to be accepted for either refund or exchange. Please contact us prior to returning any goods.
Note, this approval or return policy is in addition to and does not affect your right to return under warranty.
EXCLUSIONS

Any item that has been placed in the water or shows any signs of use or wear will not be accepted for exchange or return.

We regret that we cannot accept returns on engines or on boats that have been subject to any significant customer specified modifications, i.e. the fitting of ski arches, consoles etc., unless by prior written agreement.

The customer is responsible for all cost associated with shipping. These will be deducted from any refund and additional charges may be applicable in exchange transactions.
Warranties
All Terminator Boats are supplied with a limited 5 year warranty. Full details can be found in the owner’s manual. Download PDF versions of the manuals here >>.
Where a 3rd party supplier has fitted accessories, then claims for repair or redress under warranty should be made directly to that supplier. Full warranty details are supplied on delivery and will be issued on request.
Disclaimers
Terminator Boats Ltd shall not be held responsible for any loss or damages resulting from the sale, non-delivery, use, function or malfunction of any item purchased from us. Nor will we accept any responsibility for the customer’s final determination of suitability for the purchaser’s intended use of any item.
While every effort is made to keep our website accurate, Terminator Boats Ltd does not guarantee that product descriptions or other content is error-free, complete, reliable or current. Pictures may have been used for the purpose of illustration only. Some items shown may be for display purposes only, and are not necessarily included in the purchase price. In the event of pictorial or typographical error, Terminator Boats Ltd reserves the right to make corrections to copy or pricing that reflects the actual current status.
Caution
Boating is a fun, sporting activity with inherent risks. We strongly recommend that you obtain appropriate training and familiarise yourself with local conditions and bylaws prior to taking to the water.
